Terms of service
Introduction
These Terms and Conditions (“Terms”) govern the provision of cleaning services by Absoluto Brazilian Cleaners (“we,” “us,” or “our”) to you, the customer (“you” or “your”). By requesting or engaging our services (including submitting a quote request on our website), you agree to be bound by these Terms.
These Terms apply to all cleaning services we provide, including residential cleaning, commercial cleaning, and specialised cleaning (e.g., post-construction, move-in/move-out, deep cleaning).
These Terms are governed by New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
Definitions
“Services” means the cleaning services we provide as detailed in your quote, booking confirmation, or service agreement.
“Premises” means the residential or commercial property where the Services are performed.
“Customer” means you, the individual or business requesting or receiving the Services.
Scope of Services
We offer:
Residential cleaning (regular or one-off)
Commercial cleaning (offices, shops, clinics, etc.)
Specialised cleaning (e.g., post-construction, move-in/move-out, deep cleaning)
The exact scope, frequency, and details will be confirmed in your quote or booking confirmation. We reserve the right to refuse any request that is outside our standard services or capacity.
Service Area and Availability
We provide services throughout Auckland and surrounding areas. Availability depends on our schedule, resources, and location. We may decline requests based on distance or operational constraints.
Service Agreements and Quotes
All quotes are valid for 30 days unless stated otherwise. Prices exclude GST unless specified.
A quote or booking confirmation becomes a service agreement once you accept it (verbally, in writing, or by proceeding with payment/scheduling).
Service Fees and Payment Terms
Payment is due upon completion of the service or as agreed in the quote/confirmation.
We accept bank transfer, credit/debit card, or other methods specified.
Late payments may incur interest at 1.5% per month. We may suspend services until payment is received.
Quotes are estimates; final pricing may vary based on actual site conditions.
Cancellations and Rescheduling
You may cancel or reschedule with at least 24 hours’ notice without charge.
Less than 24 hours’ notice may incur a fee of up to 50% of the service cost.
We reserve the right to charge the full amount if we arrive and access is not provided.
Customer Responsibilities
You agree to:
Provide safe and clear access to the Premises at the scheduled time.
Remove valuables, fragile items, or obstructions that may interfere with cleaning.
Inform us of any hazards (e.g., chemicals, pets, broken items) before the service.
Secure pets and ensure the area is safe for our team.
Failure to do so may result in additional charges, delays, or refusal of service.
Health and Safety
We follow all relevant New Zealand health and safety laws. Our team is trained to handle standard cleaning tasks safely. You must notify us of any risks at the Premises.
Service Guarantee
We aim to deliver high-quality, Brazilian-inspired cleaning. If you are not satisfied, notify us within 48 hours of the service. We will make reasonable efforts to correct any issues (e.g., re-cleaning affected areas) at no extra cost, subject to fair assessment.
Limitations of Liability
We are not liable for:
Pre-existing damage to property (e.g., worn surfaces, fragile items).
Loss or damage to valuables unless specifically advised and agreed in advance.
Indirect losses (e.g., business interruption).
Damage caused by your instructions or third parties.
Our total liability is limited to the cost of the service provided.
Consumer Guarantees
Under the Consumer Guarantees Act 1993, our services come with guarantees of reasonable care and skill, and fitness for purpose. If we fail to meet these, you are entitled to a remedy (e.g., rework or refund).
Privacy
We handle your personal information in accordance with our Privacy Policy (available on our website) and the Privacy Act 2020. See our Privacy Policy for details.
Dispute Resolution
Any disputes will first be addressed through good faith discussion. If unresolved, we may refer to mediation or the Disputes Tribunal.
Force Majeure
We are not liable for delays or failure due to events beyond our control (e.g., illness, weather, restrictions). We will reschedule as soon as possible.
Changes to Terms
We may update these Terms. Changes will be posted on our website. Continued use of our services after changes means acceptance.
Governing Law
These Terms are governed by New Zealand law. Any disputes will be resolved in the courts of New Zealand.
